Thousands Call on Shapiro to Ban Road Spreading of Toxic, Radioactive Drilling Waste 

Report released today reveals that the more than 3.2 million gallons reported since the moratorium may fall far short of actual amount spread on Pennsylvania roads

 

Pennsylvania: Today, the Better Path Coalition delivered signatures from 65 organizations, institutions, and businesses, and more than 2,700 individuals on a letter and petition calling on Governor-Elect Shapiro to ban road spreading of conventional drilling waste. The delivery comes with the release of the Coalition’s update of its Moratorium Morass report on the anniversary of its release.

 

Documents obtained through a Right-to-Know request submitted to the Bureau of Waste Management (BWM) raise new concerns that road spreading of toxic, radioactive drilling waste may have gone unreported in the four years since the Department of Environmental Protection (DEP) put a moratorium on the disposal method. 

“Pennfield has obtained a Co-Product status instead of Waste with our brine. What this means is you don’t have to report spreading and it can be spread all year round. I know this is hard to believe because D.E.P. doesn’t make anything easy, but it’s true…,” the company told townships that were potential customers in a 2020 letter included in the RTK response. 

The coproduct status Pennfield mentions refers to a program managed by BWM that allows owners of a waste product to make a determination that their waste can be used in place of a commercial product that performs the same function as long as the waste is no more dangerous to health and the environment than the commercial product is. 

 

Conventional drillers took advantage of the Coproduct Determination loophole so they could continue road spreading after the DEP’s moratorium went into effect.
 

Oil & Gas Waste reports include entries on road spreading from 37 companies since 2018. However, in the three years before the moratorium, 114 companies reported road spreading. The number of companies that believed as Pennfield did that reporting was not required under the Coproduct Determination program is unknown and must be investigated.

 

“The DEP had no idea how much waste the industry was generating before the moratorium because of their deeply flawed reporting system. Now, thanks to the use of the Coproduct Determination loophole, the DEP has even less of an idea. Road spreading of unconventional waste was banned in 2016. It’s time for the ban to be extended to conventional waste too. Governor-Elect Shapiro must make it a top priority to bring this dangerously mismanaged practice to an end,” said Karen Feridun, Co-founder of the Better Path Coalition and the report’s author.

DGS Says the Climate Countdown Clock Must Go

Groups Press the Department to Reconsider Based on Pension Debt Clock on Display 6 Years and Counting

 

Harrisburg - The Better Path Coalition and organizers of the Pennsylvania Climate Convergence are challenging the response the groups received from the Department of General Services (DGS) on Friday afternoon concerning the Climate Countdown Clock on display in the East Wing of the Capitol that is ticking down the time left to limit global warming to 1.5℃.

 

The letter sent from Jason Snyder, Acting Deputy Secretary for Property and Asset Management, dated November 2, but not sent until 2 p.m. on November 4, declines the groups’ request to keep the clock on permanent display in the Capitol where it was installed on June 13, the final day of the Pennsylvania Climate Convergence. The installation is scheduled to end on November 16, the last day of the current legislative session.

 

The letter cites guidelines and criteria in the PA Code that the Department must follow. Title 4 PA Code, Chapter 86 addresses policies regarding temporary exhibits. According to 4 PA Code § 86.3(8)(v), “Exhibits may be scheduled for display for up to 14 calendar days, subject to availability of time and space.” However, a review of the Capitol Events calendar reveals several  instances when DGS appears to have had discretion to approve displays that lasted anywhere from three weeks to several months.

 

The Code says nothing about permanent exhibits like the one the groups are requesting, but another clock that has been installed at the Capitol since February 24, 2016 makes clear that years-long displays with indeterminate end dates are also permitted. Barry Shutt, an Agriculture Department retiree, installed a Pension Debt clock that, according to a Pennlive report from January 2022, “has been a fixture of the East Rotunda for years.” A tag on the clock reads, “Pennsylvania Pension Debt Clock Unveiled February 24, 2016.”

 

“We are not asking for special treatment. We’re simply asking for our clock to be given the same permanent status the Pension Debt clock has been given for nearly seven years. While we appreciate that Mr. Snyder indicated that DGS would welcome future requests to display the clock, we believe the power of a countdown clock is diminished if it is not a constant presence. We want our clock to be a fixture in the East Rotunda too,” said Karen Feridun, Co-founder of the Better Path Coalition and one of the organizers of the Pennsylvania Climate Convergence.

 

Unlike the Climate Countdown Clock that appears as an entry each day on the calendar from June 13 to November 16, the Pension Debt clock was never listed as an exhibit until November 3, the day between the date on the letter and the date it was emailed. The Pension Debt clock is listed as being on display in the Senate Fountain area from November 3 to December 2. 

 

The Climate Countdown Clock will tick down to zero in less time than the Pension Debt clock has already been on display if the state government takes no action to address the crisis. If our governor and legislature continue on their course of enabling the fossil fuel industry, as they did last week when Governor Wolf signed HB1059 that authorizes $2 billion in taxpayer subsidies to fossil fuel corporations for methane and blue hydrogen (a.k.a. methane) projects, the true time left will be even less.

 

The DGS letter states, “When individuals or groups apply for the ability to put exhibits on display, there is a mutual understanding that exhibit agreements are for a specified time-period [sic] and are temporary in nature. We work with applicants to ensure their voices are heard and their causes receive the maximum public exposure. Such was the case with your exhibit, which was prominently displayed for viewing for an extended length of time.”

 

It is precisely because we respect the mutual understanding of what we understood to be a temporary exhibit that we submitted our letter and petition calling for the display to be made permanent at the end of the agreed upon period. We are curious about the terms of the relationship Mr. Shutt has with the Department and are asking the Department to explain how it differentiates our clock from his.

 

The actions of every elected and appointed official in Pennsylvania have the potential to directly impact and accelerate the climate crisis. The Climate Clock must stay where it is until fossil fuel extraction, compression, transmission, and all related methane gas infrastructure comes to a halt. On display or not - the climate clock will not stop ticking. The clock's presence in the Capitol is a necessary reminder of that indisputable fact.

Governor Wolf Just Handed Billions in Public Money to the Industry that Set the Planet on Fire

Statement from the Better Path Coalition

​

Today, Governor Tom Wolf signed the bill that greenlights spending more than 2 billion taxpayer dollars on fossil fuel subsidies. His signature on HB1059 was anticipated, as he is one of the architects of the plan that provides more corporate welfare to the wealthiest industry in the history of industries. His action guarantees that he will leave office with an unbroken record of putting the interests of the shale gas industry above those of the public he was elected to serve.

​

In a letter to the General Assembly announcing his signature that had been removed from his site for a time, Wolf justifies his reckless act by citing the DOE’s Clean Hydrogen Production Standard that 1) is still in draft form and 2) will never be in a form that makes blue hydrogen production clean. DOE is basing its standard on the terms of the new 45v tax credit. The tax credit is based on the GREET, the Greenhouse gases, Regulated Emissions, and Energy use in Technologies, model tool developed by the DOE’s Argonne National Laboratory to do life-cycle analyses of transportation fuels and vehicles. However, GREET uses the 100-year time scale assessments from 2007 rather than the only relevant time scale now, the 20 year time scale that puts methane’s GWP at 86. Our calculation based on the relevant time scale puts blue hydrogen’s CO2e at 10.836kg, well above the limit of 4kg necessary to qualify for 45v and certainly more than should be considered “clean hydrogen” in any production standard.

​

Last week, members of the Better Path Coalition, organizers of the Pennsylvania Climate Convergence, and their partners staged a die-in at the Capitol with the message on morgue cloths that read, “You never asked me if it was ok to use my tax dollars to kill me and my family,” and sang “Which Side Are You On?” outside of Wolf’s office.

Wolf negotiated this latest gift to the shale gas industry in private. The public stuck with footing the bill was never consulted and never asked for its consent. This is the same public that will be stuck with the industry’s clean up costs, including costs that they will have to bear in perpetuity. 

​

And it is the same public whose federal tax dollars are supporting an obscene amount of giveaways and tax credits to help the industry develop self-serving false solutions, like carbon capture and blue hydrogen, that amount to nothing more than the next generation of fossil fuel development on a burning planet.

“Good Riddance, Governor Wolf,” said Karen Feridun, Co-founder of the Better Path Coalition who was one of the organizers of a Pennsylvanians Against Fracking meeting with Wolf and members of his cabinet in 2015. “We brought frontline community members and experts to Harrisburg and provided him with copies of the Compendium that summarizes all the scientific research on fracking, the New York State health study that informed the decision to ban fracking, and other key reports. The facts never mattered to him. The climate crisis never mattered to him. Pennsylvanians harmed by fracking never mattered to him. Future generations that will suffer the impacts of his enabling treatment of the industry killing them never mattered to him. His indifference will be his shameful legacy.”

 

"The Pennsylvania Economic Development For A Growing Economy (PA Edge) Tax Credits (HB1059) dangles cyclical, repetitive, short-term labor promises while sacrificing the health and safety of residents, increasing methane emissions into the atmosphere, and forcing laborers to end up once again in a vulnerable, exploitative situation after construction. Without public comment, regulatory accountability, or long-term labor force development, the Pennsylvania House and Senate voted in favor of HB 1059. Die-In at Capitol Calls Out Deadly Action Taken by Wolf, Lawmakers to Subsidize Methane

“You never asked me if it was ok to use my tax dollars to kill me and my family.”

 

Harrisburg - Members of the Better Path Coalition and their partners staged a die-in at the Capitol building today to call out Governor Tom Wolf and the state legislature for enacting billions in new methane subsidies. The legislation passed just hours after headlines like this one from Bloomberg warned, “Earth’s on Track to Warm Above 2C Despite Climate Action.” 

 

“Climate scientists are screaming at the top of their lungs that we are running out of time, and meanwhile the PA legislature just passed a bipartisan suicide pact. I am furious that my hard earned taxpayer money is being used to subsidize the fossil fuel industries destroying our planet.”  said Chie Togami, PhD candidate at the University of Pittsburgh.

 

The move is consistent with the actions of an administration and legislature that have existed in a bipartisan bubble of denial about climate change. 

 

“Robbing Pennsylvanians of their tax dollars without their consent or even their knowledge is a grievous injustice. Using their money to kill them is a crime,” said Karen Feridun, Co-founder of the Better Path Coalition. “Make no mistake. Subsidizing methane production directly and indirectly to fund blue hydrogen projects when the planet is already burning is a crime against humanity and should be treated as such.”

 

Some of the protesters covered themselves in “morgue cloths” that read “You never asked me if it was ok to use my tax dollars to kill me and my family.” 

 

“Passage of Bill HB1059 means the Pennsylvania taxpayer is subsidizing harm to their health and lives for generations to come without consent,” Tamela Trussell, Move Past Plastic, Founder/Educator.

 

"If Wolf fails to veto this piece of greedy, climate-denying legislation, our children will pay a price far beyond $2.1 billion with unnecessary morbidity and mortality. It is reprehensible. There is no political-hands-tied excuse for these subsidies. If Wolf wants to protect our children's health, he will veto this legislation," Tammy Murphy, Advocacy Director, Physicians for Social Responsibility Pennsylvania.

 

In May, Governor Wolf announced that the state government was actively pursuing the creation of a hydrogen hub, willfully perpetuating a lie the fossil fuel industry has been pushing that claims that producing hydrogen from methane is somehow clean. All producing hydrogen from methane does is keep the natural gas industry in business and, by extension, keep Wolf and his ilk in office.

 

“The passage of this bill means that Pennsylvania will be subsidizing the climate crisis, environmental destruction, and negative health outcomes for decades, if not generations,” said Karen Elias, a member of the Climate Reality Project.

 

“I am wondering what $2.1 billion could do to alleviate Gov. Wolf's complaint that (R) legislators did not provide funding for, "Urgently needed behavioral health services funding, $2,000 direct payments,Voting reform, Gun violence, or Anti-discrimination protections," said Chris DiGiulio, Co-founder of WaSEPA.

 

“The fossil fuel industry continues to deny the destruction they are causing. We must not accept expansion of natural gas production and blue hydrogen. This would cost us too much. Wolf, State Legislature Plan More Natural Gas Subsidies as Planet Burns

If the Wolf administration and state lawmakers are successful at enacting massive natural gas subsidies before the end of the session, they will leave behind a mess the rest of the world will have to clean up to avoid the worst impacts of climate change. Pennsylvania’s role as a climate pariah will be cemented.

 

According to reporting from Spotlight PA on negotiations that have been occurring “quietly,” the subsidies would amount to $80 million per year for a combination of direct natural gas subsidies and an indirect greenwashed hydrogen subsidy, all of which would mean lots more drilling and fracking. 

 

The direct giveaway comes in the form of an expansion of another election-timed subsidy in 2020 that was a version of the session’s failed HB1100 that was jammed into an unrelated bill as an amendment and passed, once again, “quietly.” The subsidy was made for companies like Nacero whose plans for a natural gas to gasoline refinery were discussed “quietly” by the Wolf administration and lawmakers for two years before the taxpayers financing the deal were made aware of it.

 

The portion of the plan that is greenwashed corporate welfare takes the form of a subsidy to promote hydrogen production. The federal government is already investing an obscene amount of public money into false climate solutions like hydrogen with carbon capture and storage. If Wolf and his frenemies in the state legislature have their way, Pennsylvania taxpayers will be dealt a double whammy of subsidizing the natural gas industry twice. The hydrogen economy Pennsylvania wants to create is one that uses natural gas as the feedstock for hydrogen production. 

 

Disingenuous politicians insist that carbon capture and storage will be used to remove the CO2 emissions that occur along the way so that the process can be made “clean”. Unfortunately, there is no evidence to support their claims and plenty to demonstrate that carbon capture and storage is a fantasy. Those same politicians completely overlook the methane emissions that occur at every step of natural gas production as well as the beyond-the-grave emissions that come from the hundreds of thousands of abandoned wells the state has failed miserably to address.

 

It would be hard to imagine a worse energy plan for Pennsylvania. Our state government is an embarrassment, but that’s the least of our worries if the bad actors who populate it succeed in creating these subsidies.

Thousands Call on PA Department of General Services to Keep Climate Countdown Clock in Capitol

Six-Foot Clock, Second Biggest in U.S., Is Necessary Reminder to Government Officials that Time to Act on Climate Is Fleeting

 

Harrisburg, PA – Today, the Better Path Coalition and organizers of the Pennsylvania Climate Convergence delivered a letter signed by 60 organizations and an accompanying petition with more than 3,000 signatures to Department of General Services Acting Secretary Joe Lee calling for the climate countdown clock’s installation in the East Wing of the Capitol to be made permanent.

​

The six-foot clock was installed in the Capitol in June on the last day of the Pennsylvania Climate Convergence. It is the second biggest clock of its kind in the country, surpassed only by the original clock in Union Square, NY. The Department of General Services agreed to keep the clock on display until the end of the session in November. Organizers were told at the time that items can be displayed for months, but not permanently.

“The thousands who signed our letter and petition are calling on the Capitol to make an exception to its policy and keep the clock on display in its current location permanently. Our government is failing us on climate, not by its inaction, but by the aggressive steps it continues to take to expand fossil fuel development in the state. Our clock serves as a constant reminder to our governor, legislators, regulators, and everyone who passes through the busy corridor that time is running out,” said Karen Feridun, Co-founder of the Better Path Coalition and one of the lead organizers of the Pennsylvania Climate Convergence.

Since its installation in June, the time displayed on the clock has ticked down from seven years to six.

​

“Droughts, hurricanes and floods are no longer ‘hundred year’ events. Communities that have the resources are still resilient enough to recover; those that lack the resources are not. Resilience, however, is not infinite. If we do nothing, it will become more and more difficult for any community to recover. If we do nothing, the Earth herself becomes a frontline community. The clock is ticking, and we are running out of time,” said Ellen Gerhart, a Better Path Coalition member whose property is directly impacted by Mariner East 2 and 2x and whose family home in Beaver County sits in the shadow of the Shell cracker plant.

Dawn Kane, a Better Path Coalition organizer spoke at the press conference as an educator who has worked with students worldwide. Kane said, “In my travels to places like India, East Africa, and Mexico as a teacher of English, I have been confronted with the profound vulnerability that exists in the least developed communities. I have seen barefoot, emaciated children herding cows down dusty tracks in a search for water over drought-stricken grasslands. I have watched children wading through filthy flooded camps in India trying to find a dry space to rest. In Northern Mexico the brown haze hovers over the landscape and, according to the World Bank, kills 33,000 Mexicans every, single, year. According to a report from last year’s UN Conference on Trade and Development, the level of CO2 emissions per capita by the average US citizen is more than five times that of the average person living in Mexico.”

“The climate clock needs to remain in the Capitol as a visible reminder that we do not have time for endless speculative and time-consuming distractions,” said Rachel Mark a founding member of the Better Path Coalition, referring to the state’s push to develop a hydrogen hub that would be based on hydrogen produced from fracked methane.

“Pennsylvania has been proudly and lucratively exporting energy since before the industrial revolution started. Pennsylvania is now rivaling Texas as the state with the most greenhouse gas emissions. When we realize the harm that this is causing around the world, we must recognize that change must come soon and rapidly. There is no time to lose,” said Barbara Brandom, Steering Committee Member, Concerned Health Professionals of Pennsylvania.

The group delivered copies of the letter to Governor Wolf and legislative leaders. "We were pleased that just about everyone we talked to had seen the clock and were very familiar with it. Knowing that the clock is being noticed just strengthens our resolve to keep it in the Capitol permanently," said Feridun.

 

The Better Path Coalition and Pennsylvania Climate Convergence organizers are seeking a response from the Acting Secretary Lee by November 9.

Conventional Drillers Spread Nearly 1,000,000 Gallons of Toxic Radioactive Waste on PA Roads in 2021

Better Path Coalition’s Updated Moratorium Morass Report Finds Continued Illegal Spreading of Waste Thanks to Regulatory Loophole

Conventional drillers reported spreading 23,277.89 barrels or 977,671.38 gallons of waste in 2021. The total was calculated by tallying amounts reported in 1,107 records from nine counties submitted by 21 conventional drillers, says the Better Path Coalition in an update of its 2021 Moratorium Morass brief  released today.

Eight companies were added to the list of waste owners spreading their toxic, radioactive waste on unpaved roads as a dust suppressant despite a moratorium on the practice established by the Department of Environmental Protection in 2018. Since that time, several conventional drillers have taken advantage of a Bureau of Waste Management loophole called Coproduct Determination.

“The continued abuse of the Coproduct Determination program signals the need to outlaw road spreading once and for all,” said Karen Feridun, Co-founder of the Better Path Coalition. “The DEP continues to make an artificial distinction between unconventional drillers who have been barred from spreading fracking waste for years and conventional drillers, when the conventional drilling industry openly admits that most operators today frack. There’s no difference. Fracking waste is fracking waste. Period.”

Under the Coproduct Determination program, owners of waste can determine whether or not their waste is equivalent to a commercial product. If they assess that it is, they can start using or selling their product without having to notify the Bureau of Waste Management. The assessment should be written in a report that can be turned over to the Bureau upon request.

In 2021, the Bureau began reaching out to drillers to request determinations. Some never responded and two requested more time. The determinations submitted by those who did respond did not conform to the program’s regulatory requirements.

In May, the Department of Environmental Protection sent letters to 18 municipalities informing them that 10 drilling companies had spread waste illegally. One of them, Energy Resources of America, Inc., had not responded to the agency’s outreach as of December of 2021. It was among the six companies identified in the letters that continued spreading waste on roads in 2021 and the only to report spreading more waste last year than it did in 2020. The six companies are responsible for roughly 43% of the waste spread in 2021.

The coalition is submitting the report to Governor Wolf who ordered DEP to review compliance records of conventional drillers and report the results by September 1 in hopes that our report will assist him in his own review of the data.

Wolf Must Act Aggressively on Climate in Wake of SCOTUS Ruling

A  Statement from the Better Path Coalition

The Better Path Coalition calls on Governor Tom Wolf to take aggressive action on climate change in the wake of the Supreme Court’s ruling on West Virginia v EPA that puts federal climate policy in a regulatory and legislative gridlock.

The Pennsylvania Department of Environmental Protection’s Acting Secretary Ziadeh issued a reaction that opens, “Governor Tom Wolf and DEP have been at the forefront of protecting the air we breathe and ensuring that communities are not bearing unfair burdens from regulations protecting air quality. Cost-effective actions like reducing methane leaks from gas wells and participating in the Regional Greenhouse Gas Initiative will continue to improve Pennsylvania’s air for years to come.”

We must correct the record. To date, the Wolf administration and our state legislators have moved the state in the wrong direction on climate with their efforts to enable expanded fossil fuel and petrochemical production, support false climate solutions conjured up by the greenhouse gas industry only interested in doing business as usual, and distract the public with histrionics over incremental climate measures like the Regional Greenhouse Gas Initiative.

The actions of a Supreme Court gone rogue now make it imperative that the states step up. In the case of our state, that first step is a giant, but necessary one that reckons with the fact that the only way Pennsylvania can be part of the solution, not part of the problem, is to start phasing out fossil fuel production today.

PA Hydrogen Hub Is a False Climate Solution

A  Statement from the Better Path Coalition

​

The fossil fuel industry has been promoting a combination of false solutions to the climate crisis that sound promising, but amount to nothing more than a means to continuing to do business as usual. In Pennsylvania, the industry’s effort is coming in the form of the hydrogen hub proposed in February by EQT Corporation, Equinor, GE Gas Power, Marathon Petroleum (including its affiliate MPLX), Mitsubishi Power, Shell Polymers and U. S. Steel, in addition to other proposals like the Nacero gas-to-gasoline refinery proposed for Luzerne County.

 

Today’s announcement by Governor Wolf of an aggressive push to see the hydrogen hub come to fruition is disappointing, but not surprising. Throughout his administration, Wolf has consistently put the industry’s interests over those of the public he was elected to serve.

 

Cornell’s Robert Howarth and Stanford’s Mark Jacobson concluded that “there is no role for blue hydrogen in a carbon free future” in their analysis that found that “blue hydrogen has emissions as large as or larger than those of natural gas used for heat.”

Blue Hydrogen and Gray Hydrogen both produced by natural gas are different from each other in an important way. What makes Blue Hydrogen blue is the use of carbon capture and storage (CCS). CCS, a failed and costly experiment in its own right, would bring to the state a new series of CO2 pipelines that would be much more hazardous than the natural gas and hazardous natural gas liquids pipelines that already crisscross the state.

 

We are absolutely out of time for the magical thinking of weak elected officials who lack the courage to stand up to the industry and the creativity to come up with real climate solutions.

Conventional Drillers Soft Pedal Status of Road Spreading of Toxic Drilling Waste

A  Statement from the Better Path Coalition

Today, the PA Grade Crude Development Advisory Council (CDAC), a council made up largely of industry representatives that meets regularly with regulators in the Pennsylvania Department of Environmental Protection’s Oil & Gas Division, soft pedaled the industry’s response to the agency’s Bureau of Waste Management’s inquiry into how drillers determined that their drilling waste could be used as a dust suppressant on roads. Although the Council makes no attempt to make its public meeting audible, industry representatives could be heard trying to make a case that much-maligned conventional drillers have done their best to cooperate with the conditions for making controversial Coproduct Determinations and expressing their dissatisfaction that a Special Investigator for the Attorney General’s office is also looking into their use of the program.

Contrary to CDAC members’ claims, the Oil & Gas Waste report shows that road spreading continues and has increased since 2020.  Among the operators are those who failed to respond to the Bureau of Waste Management’s requests for documentation that a determination had been made or submitted in adequate reports. The report also includes entries from seven companies that did not report road spreading since the moratorium took effect in 2018.

According to the Oil & Gas Waste reporting system, 13437.88 barrels, or 564390.96 gallons, of toxic, radioactive conventional drilling waste were spread on unpaved roads in Pennsylvania 2021. The total represents a 5.05% increase over the 12,792 barrels or 537264 gallons spread in 2020. This comes despite efforts by the agency’s Bureau of Waste Management to clamp down on the use by drillers of a beneficial use program called Coproduct Determination that allowed road spreading to continue after the Oil and Gas Division put a moratorium on the practice in 2018.

The program allows the owner of a waste product to determine if their waste can perform the same function as a commercial product and then start using it without having to notify the DEP. However, if the DEP requests a copy of the Coproduct Determination report, the waste owner must provide it. Section 287.8 of the Pennsylvania Code lays out the rules for making Coproduct Determinations. Not a single driller asked to submit a copy of its determination by the Bureau last year came close to meeting the requirements. Eleven of those drillers continued to road spread in 2021.

The Better Path Coalition has updated the chart it published in last year’s report, Moratorium Morass, that looked at the issues with the Coproduct Determination loophole as well as numerous problems with the DEP’s reporting system. Our chart shows the names of the companies that reported road spreading in 2021, the amount they spread, the status of their response to the BWM as of December 2021, and notes that point to some questions about the numbers reported.  You can review our chart here.

Drillers’ Disregard for Road Spreading Requirements Revealed in Right-to-Know

New brief documents DEP’s failure to manage toxic waste

​

A new brief released today by the Better Path Coalition called The Moratorium Morass provides the public its first look at assessments conventional drillers were supposed to make before spreading more than 2.2 million gallons of toxic, radioactive drilling waste on unpaved roads in the Commonwealth.

​

For the first time since the Department of Environmental Protection’s 2018 moratorium on road spreading, the Bureau of Waste Management asked 17 drillers to provide determinations they were supposed to conduct before continuing road spreading using a loophole called Coproduct Determination. The Better Path Coalition obtained eight of the self-determinations in response to a Right-to-Know request filed in October.

​

Three of the eight drillers responded with copies of lab reports. A fourth accompanied its lab report with a one-page township resolution approving road spreading. The other four companies submitted an assortment of things like township endorsement form letters and safety sheets for the commercial product they use for comparison. None of the determinations came close to satisfying the requirements laid out in the PA Code.

​

“DEP Secretary Patrick McDonnell would be, and probably should be, challenged to provide a detailed accounting of where waste has been spread and in what quantities, as well as a demonstration that the waste has posed no threat to human health or the environment. The fact is, he can’t,” says Karen Feridun, one of the co-founders of the coalition and the brief’s author.

​

Feridun’s attempt to use the Oil and Gas Division’s Oil and Gas Reporting Electronic (OGRE) system to track where the waste has gone revealed many problems with the system’s design and entries that should set off alarms but don’t. One determination DEP provided was from Pennfield Energy, even though the company has not reported road spreading since 2017, before the moratorium. In fact, Pennfield has not reported any waste disposal since 2017 despite the fact that gas production reports show that the company produced nearly 10166 barrels of oil between 2018 and 2020.

“The industry has been unrelenting in its efforts to see road spreading reinstated, but this regulatory Wild West scene is playing out against a backdrop of peer reviewed research that says the waste is a hazard. The DEP banned road spreading of unconventional waste in 2016. It’s time to ban all road spreading of oil and gas wastewater,” says Feridun.

Better Path Coalition Submitting Right-to-Know on Coproduct Determination Loophole

Today, the Better Path Coalition submitted to Secretary Patrick McDonnell  and Deputy Secretary Scott Perry a letter signed by 80 organizations and businesses and more than 1,800 concerned citizens calling  on the agency to ban road spreading of drilling waste. The letter comes in the wake of concerning  comments made by DEP representatives at a recent  PA Grade Crude Development Advisory Council meeting indicating that the agency is seeking data to support the reinstatement the road spreading  of toxic, radioactive drilling waste.

Kurt Klapkowski, Director of the Bureau of Oil and Gas Planning and Program Management told the Council, “We have to be able to defend our decisions with data. And that was the attempt, with working with Penn State, that's what we were attempting to do was to develop that data to be able to have a program that we could go to the Environmental Hearing Board and the Commonwealth Court and Supreme Court under the constitution and under the statutes that we administer, that would be defensible.”

​

“This is a blantant example of how poorly our captured environmental regulators are serving the public’s interests. Not only is the agency willing to do the industry’s bidding by shopping for data to support the reinstatement of a road spreading program, it is willing to allow a loophole to exist that  means the practice has never really halted in Pennsylvania,” said Karen Feridun,  Co-founder of the Better  Path Coalition.

A Bureau of Waste Management beneficial use loophole referred to as a Coproduct Determination allows road spreading of waste if the driller has deemed its waste product to be on par with commercial products. This summer, the DEP requested documentation of those self-determinations for the first time since the moratorium on road spreading went into effect.  The Better Path Coalition has submitted a Right-to-Know request for copies of those original determination documents.

As the Coalition was preparing to submit today’s letter, Barbara Brandom of Concerned Health Professionals of PA shared with us a response she recently received from the PA Department of Health.  She’d contacted the agency about her concerns regarding the health impacts associated with road spreading. The DOH responded that it had contacted DEP and was unaware of any road spreading occurring in the Commonwealth. Apparently, the agency does not know about and was not told by DEP about the Coproduct Determination loophole.

​

The DEP's failure to adequately inform the DOH of the potential risks of health impacts reinforces the need to establish a formal process for the DOH to be a part of authorizing any process that involves pathways for negative individual and public health consequences because they have the medical expertise and the DEP does not," said  Tammy Murphy, Medical Advocacy Director, Physicians for Social Responsibility Pennsylvania.

 “Our environmental regulators are only now starting to assess how much waste is being spread on our roads, and has been since 2018, and our public health officials don’t know about any of it. A ban on road spreading would effectively close the loophole and stop the insanity,” said Feridun.

Pennsylvanians from the Sacrifice Zones and Those in Solidarity Tell Wolf He Based His Decision to Vote for Delaware River Basin Fracking Ban on Them

 

More than 1,000 Pennsylvanians signed a letter delivered to Governor Wolf today by members of the Better Path Coalition called ‘We are the ones’. The letter was  written in response to Governor Wolf’s vote on February 25 to ban fracking in the Delaware River Basin. 

 

Coalition members dressed in black carried a banner saying “We are the ones” from the rotunda to Wolf’s office where they unfurled a scroll of the nearly 2,000 signers that also comprise out of state supporters, some of them former Pennsylvanians who left the state because of fracking. The letter is written in the style of a poem.  Members of the group read the 36 stanzas aloud in front of Wolf’s office.

 

The letter is written from the perspective of the Pennsylvanians who helped inform the decision to ban fracking. The resolution establishing the ban cites “scientific and technical literature and the reports, studies, findings and conclusions of other government agencies” and adverse impacts “more than a decade of experience with HVHF in regions outside the Delaware River Basin have evidenced, despite the dissemination of industry best practices and government regulation”. 

 

"Governor Wolf may have been looking at data points in studies, but he was actually looking at the Pennsylvanians they represent. He may have read reports of the leaks, spills, fires, explosions, earthquakes, and myriad other industrial and regulatory failures, but he was reading about the harms done to Pennsylvanians who suffer their consequences. Wolf  was looking at his own constituents. It is unacceptable that he supports condemning them to at least two more decades of drilling and fracking to pay for his Back to Work, PA plan. Coalition to Wolf: “How Much More Evidence for a Statewide Ban on Fracking Do You Need?”

Governor Tom Wolf didn’t want to see the young children dressed as the Lorax who visited his office in 2019 to deliver a petition calling on him and state legislators to uphold the environmental rights enshrined in Article 1, Section 27 of the Pennsylvania constitution. He eventually relented and posed for some photos with the children. Within months of that visit, some of those children discovered that they had alarming levels of chemicals associated with fracking in their bodies.

​

Today, Environmental Health News released the findings of its two-year investigation into exposures of families in southwestern Pennsylvania to fracking chemicals called Fractured: The Body Burden of Living near Fracking. The chilling results show that families living near fracking operations have alarming levels of chemicals like xylene, ethylbenzene, styrene, toluene, and others in their bodies, in their air, and in their water.

​

Last week, Governor Wolf and the other Delaware River Basin Commissioners banned fracking in the basin. The resolution they passed states, “As the scientific and technical literature and the reports, studies, findings and conclusions of other government agencies reviewed by the Commission have documented, and as the more than a decade of experience with high volume hydraulic fracturing in regions outside the Delaware River Basin have evidenced, despite the dissemination of industry best practices and government regulation, high volume hydraulic fracturing and related activities have adversely impacted surface water and groundwater resources, including sources of drinking water, and have harmed aquatic life in some regions where these activities have been performed.”

​

In other words, the Commissioners looked to the experience of the Lorax kids, their families, and the other families in EHN’s report, as well as many other families, including some who are demanding action on the spike in rare cancers in young people first reported months after Team Lorax occupied the Governor’s office. 

​

The infuriating part is that the Commissioners announced their intention to ban fracking in 2017, two years before events of 2019. They had sufficient evidence then, when only about 700 studies had been done. Today’s report from EHN is the latest contribution to a body of research that now totals about 2,000 studies.

​

How much more evidence does Governor Wolf need to provide the same protection to Pennsylvanians in the shale fields he was prepared to provide to people in the Delaware River Basin four years ago?

Coalition to Wolf: No Sacrifice Zones in PA

Statement from the Better Path Coalition

 

 

Today, Governor Tom Wolf voted with the governors of New York, New Jersey, and Delaware to ban fracking in the Delaware River Basin and to remove from consideration regulations that would have allowed the transfer of water from the basin to fracking operations elsewhere and the importing of fracking wastewater for treatment, processing, storage, or disposal.

 

We congratulate our allies who have fought for this ban for 11 years and worked to stop the additional regulations proposed in 2017.

 

The reasons cited for today’s decision include the rapidly growing body of peer-reviewed science on the adverse impacts of shale gas development and evidence of the harms done in areas outside the basin for more than a decade. Many of those studies include or focus specifically on data from Pennsylvania. Many of the harms they have noted have occurred in Pennsylvania. For too many Pennsylvanians, the harms are still occurring with no end in sight.

 

Communities outside of the Delaware River Basin are entitled to the same protections as those within it. We reject allowing any part of the state to be a sacrifice zone,

A Day after the Biden Administration Announces Measures to Address Climate Change, Governor Wolf Announces His Plans to Condemn PA to 20 More Years of Fracking

Today, Governor Tom Wolf announced that he will propose an infrastructure plan in next week’s budget address that is similar to his previous Restore PA plan that would be funded with a severance tax on natural gas drilling.

‘How come other states can have a severance tax?’ isn’t sufficient justification for condemning Pennsylvania’s communities and families to more decades of destruction, illness, death, lost property value, contaminated drinking water, lost quality of life, threats to safety, and all of the other adverse effects shale gas development has brought for more than a decade and a half. Fracking’s impacts on climate change make his plans for Restore PA Redux all the more unjustifiable.

The profound disruption to life as usual that the pandemic has caused is just a preview of the kind of irreversible disruption the next generation and every  generation thereafter will have to endure unless we do absolutely everything right now to transition to renewable, sustainable energy and put a hard stop on the environmental injustice of tolerating sacrifice zones.

Wolf has failed each year to get his tax. He probably won’t succeed this year either. Another failure might spare communities the guarantee of 20 years or more of fracking, but it also means that this governor is wasting precious time tilting at windmills instead of investing in them.

Coalition to Cutler: Climate Change Denier Metcalfe Must Be Replaced in New Session

Metcalfe Calls Veterans Fighting Climate Change Traitors and Exhibits Ignorance of Science in Eulogy to Green Vegetables in Examples Spanning More Than a Decade

Today, the Better Path Coalition delivered a letter signed by 42 organizations calling on Speaker Bryan Cutler to replace Representative Daryl Metcalfe as chair of the House Environmental Resources and Energy Committee. The coalition began calling for his removal soon after the avowed climate denier was given the most influential legislative seat on climate policy by Cutler’s predecessor, Mike Turzai.

The letter states, “As we approach the beginning of a new session, we call on you to replace Representative Daryl Metcalfe as chair of the Environmental Resources and Energy Committee and remove him from the Climate Change Advisory Committee. A minimum qualification of the person who wields the most power on climate policy in the legislature is that they accept climate change. Metcalfe is an unabashed climate denier.”

“Another year of record-breaking extreme weather is coming to a close. Seventy percent of Pennsylvanians are calling for climate action. A new legislative session is about to begin. As extreme weather records have fallen with alarming frequency, public support for climate action has grown. Speaker Cutler has no choice but to seize this opportunity to name a chair who has the skills and the basic understanding of science needed to address the unfolding climate crisis,” said Karen Feridun, Co-founder of the Better Path Coalition.”

Diane Sipe of Marcellus Outreach Butler, situated in the PA county where Metcalfe’s constituency resides, said, “Metcalfe is a fringe outlier being afforded a platform as the Chair of the Pennsylvania House Environmental Resources and Energy Committee to elevate his out-of-touch views as if they were mainstream. In fact, the mainstream view, including Metcalfe’s party, is more aptly provided by Tom Ridge, former PA Governor and the first U.S. secretary of homeland security. In an interview with the PA Environmental Council this past May, Ridge remarked that ‘… I don’t know how people can, in this day and age…It’s almost medieval to deny science! And I think it’s somewhat of a shameful proposition.’ Elsewhere Ridge warned his party, ‘The Republican Party has largely abandoned environmental issues—to its great detriment politically.’ Speaker Cutler would best serve his party as well as the Commonwealth by installing a mainstream Committee Chair to replace Metcalfe.”

The letter cites examples of Metcalfe’s inflammatory statements that reveal his poor grasp on science that span more than a decade.

“Here is his reaction in 2009 to Operation Free. "As a veteran, I believe that any veteran lending their name, to promote the leftist propaganda of global warming and climate change, in an effort to control more of the wealth created in our economy, through cap and tax type policies, all in the name of national security, is a traitor to the oath he or she took to defend the Constitution of our great nation!" Mr. Metcalfe's email reads. "Remember Benedict Arnold before giving credibility to a veteran who uses their service as a means to promote a leftist agenda. Drill Baby Drill!!!" (Post-Gazette, October 20, 2009)”

“Ten years later, soon after Speaker Turzai made him chair of the committee, he said the following and posted it on his Facebook page, “Just to be on record, I enjoy my vegetables, and plants need CO2, so I want to make sure we have plenty of CO2 out there so we have green grass and green vegetables growing... We need CO2, we can’t eliminate all CO2. We are going to have an interesting debate for those that want to reduce something that is actually needed by our environment. And claiming that they are improving the environment.” (Representative Metcalfe’s Facebook page, February 2019)”

 A new study by scientists at Stanford University, published in the Proceedings of the National Academy of Sciences, tested whether hotter temperatures and higher carbon dioxide levels that we’ll see post-2050 will benefit the kinds of plants that live in California grasslands. They found that carbon dioxide at higher levels than today (400 ppm) did not significantly change plant growth, while higher temperatures had a negative effect.

 The Coalition initially submitted a letter signed by 38 organizations and a petition with more than 5500 signatures to Turzai last February. They received no response. The petition now has more than 7600 signatures

Governor Wolf’s Plans to Study Fracking’s Health Impacts Fall Short

 

Today’s announcement that University of Pittsburgh researchers will carry out the studies on fracking’s impacts on health promised by Governor Tom Wolf more than a year ago fail to adequately address the urgency of the need for action on the spike in rare cancers in young people, according to advocacy organizations who called on the administration to investigate the cancers after they were reported by Post-Gazette investigative reporters in May of 2019.  Additionally, plans for the second study, on acute health impacts, raise more questions than they answer.

​

“Families don’t have two more years to wait for studies to be completed. They’ve already had to wait more than a year for today’s announcement. If the studies are completed on time, they’ll arrive on Wolf’s desk just as he’s preparing to leave office,” says Karen Feridun, Co-founder of  the Better Path Coalition. “If you’re trying to keep your child safe from exposures that could cause the cancers that have affected so many already, today’s announcement gives you nothing.”

According to today’s release, the study on acute impacts will use data from southwestern Pennsylvania. There are no plans to look at health impacts occurring in other parts of the state where shale gas development has been occurring for more than a decade or polluting infrastructure like pipelines, power plants, processing facilities have impacted communities.

​

The limited geographical scope of the study isn’t the only concern. The release says that the study will attempt to replicate the results of other studies on a range of conditions, including asthma and birth outcomes.

​

“Pennsylvania is the poster child for documented health harms from drilling and fracking operations — including harms to pregnant women, infants, and children — as is evidenced by a multitude of peer-reviewed papers on the very issues that will become the focus of this new pair of studies. Corroborating research is always clarifying but should never be used as an excuse for inaction. Fracking in Pennsylvania contaminates water, pollutes air, and hurts public health. More than ten years into the fracking boom, any remaining need for benefit of the doubt belongs to the exposed children, not to the shale gas industry harming them,”  says biologist Sandra Steingraber, Ph.D., co-founder Concerned Health Professionals New York and co-author of the just released Compendium of Scientific, Medical, and Media Findings Demonstrating the Risks and Harms of Fracking (Unconventional Gas and Oil Extraction), 7th edition.

“I can’t help but think of Secretary Levine’s response to COVID-19 when guidance was changing from day to day. She didn’t need to see peer-reviewed research that established a causal link between wearing a mask and avoiding infection. She did what public health professionals do. She took action based on the best information she had at the moment. Why are  fracking-related health impacts held to a different standard?,” questions Feridun.

Better Path Coalition Announces Donations of Water and Water Buffaloes to Affected Regions, Communities, Families; Attempts to Deliver Invoice to DEP

 

On Tuesday, the Better Path Coalition called on the Pennsylvania legislature to create a Clean Drinking Water Fund to provide permanent replacement water to Pennsylvanians whose private water supplies have been fouled by shale gas activities. During a morning press conference, members of the coalition called it the first step to addressing the many impacts Pennsylvanians experience, not just to their water quality, but to their air quality, health, property, and more.

On Wednesday, author and biologist Dr. Sandra Steingraber previewed the upcoming 7th edition of The Compendium of Scientific, Medical, and Media Findings Demonstrating Risks and Harms of Fracking in a pair of briefings for legislators, other public officials, the press, and the public.

The briefings opened with a statement by Janice Blanock, mother of Luke Blanock who died at the age of 19 after a three-year battle with Ewing Sarcoma. Blanock was one of the relatives of young people diagnosed with rare cancers in southwestern Pennsylvania to travel to Harrisburg a year ago who confronted Governor Tom Wolf with pleas to investigate the rare cancers. Four days later, Wolf announced two studies on fracking’s impacts on health and possible links to the cancers.

The following are key messages from the two days of events:

  • The hundreds of peer-reviewed studies published over the past year that bring the total summarized in the new edition of the Compendium to more than 2,000 fill in the missing background pieces of a puzzle whose picture has been easy to discern for years, said Steingraber.

  • As the evidence of shale gas development’s profound impacts mounts, the Wolf administration continues to drag its feet on beginning the studies promised a year ago. Blanock received a call from Department of Health Secretary Rachel Levine the day before Wolf announced the studies to give her the news first and tell her that it would take about a month to select a research institution to conduct the studies. After a year, including the five months before the pandemic, no selection has been made.

  • Steingraber said that while peer-reviewed research is necessary, it should not become an obstacle to taking action to protect children. Public officials should not wait for proof before taking action. She compares it to telling her children to stop swimming in the lake when she hears the first distant rumble of thunder. She doesn’t need to see someone electrocuted to determine that it’s unsafe to be in the water during a thunderstorm.

  • The Wolf administration, like its predecessors, is not just failing to prevent harm, it is failing to help Pennsylvanians after harm has occurred. The Better Path Coalition announced that it is donating water buffaloes to southwestern and northeastern  Pennsylvania and water to the Woodlands in Butler County, Dimock in Susquehanna County, and the Tarr family in Chester County whose water supply has been contaminated as a result of horizontal directional drilling during the construction of the Mariner East pipeline project. The help the Coalition can provide is limited and that’s the point. Pennsylvanians who have suffered impacts are often either left to their own devices to deal with the damage done or to receive assistance from organizations, churches, community groups, and friends.

  • Charitable acts are invaluable and appreciated, but they are not a reasonable alternative to the support that should be coming from the government and the industry responsible for the harms, said the Coalition. The group attempted to deliver an invoice to the DEP at an action that followed Tuesday morning’s press conference.

  • The Coalition believes it is past time for a conversation in this state about how these impacts and others should be addressed. The group cited a story reported in the Pittsburgh Post-Gazette last summer on the DEP’s plans to raise fees in drilling permits. The article explained that they agency used fines received from permit violations, including the $30.6 million collected from Energy Transfer after the Revolution pipeline explosion in 2018 to fund the oil and gas program. Not a dime of the money collected was used to help the family who lost their home rebuild or relocate. None of the money was used to provide counseling to the traumatized neighbors, replace vehicles destroyed, or repair damage to other properties.

  • Pennsylvanians are left to their own devices to deal with the harms they have endured. Some are still showering, laundering, and flushing toilets with contaminated water.  Others are spending their own money to install and fill water buffaloes for those uses and purchase jugs of drinking water. Some Pennsylvanians seek justice and restitution in protracted legal battles while others sign Non-Disclosure Agreements that silence them and deprive the public record of valuable information.

  • The Coalition also referenced a conversation with staff attorneys at the DEP. The attorneys told the group that they believed fines collected stemming from the Grand Jury investigation would go to the Clean Streams Fund. When asked if the money could go to a Clean Drinking Water fund to provide permanent replacement water to Pennsylvanians whose private water wells had been contaminated by shale gas activities, the attorneys said that no such fund currently exists and would need to be created via legislation.

Wolf’s Signature on HB732 Says Everything You Need to Know about Him

Statement from the Better Path Coalition

 

 

With his signature on HB732, Governor Tom Wolf has made clear that his allegiance is with the shale gas industry, not the people he was elected to serve. He can no longer hide behind half-baked attempts to curb emissions now that he has used his veto of HB1100 as a bargaining chip to negotiate a version of a climate-killing bill he finds more palatable because it provides prevailing wage protection to temporary construction workers.

 

His refusal to stop handing loaded pistols in the form of permits to drilling companies found by the 43rd Statewide Grand Jury to be guilty of criminal activity showed that he was not taking the Attorney General’s investigation seriously. With his signature on HB732, he has proved that he is actually willing to subsidize projects that will make those same companies even more profitable.

 

He has turned a blind eye to the Grand Jury’s scathing critique of the Department of Environmental Protection and has elected, instead, to put the already-captured agency under even more political pressure to grant permits for projects that are so desirable to our ethically bankrupt administration and legislature that they were willing to legislate their endorsement.

 

With his signature, Governor Wolf has erased any thought that he is anything but a hypocrite on climate and a willing sycophant of the shale gas industry.

Mark Ruffalo Joins 30 Organizations in Calling on Governor Wolf to Veto Sneaky Petrochemical Subsidy Bill Passed by the Legislature

 

Actor and activist Mark Ruffalo and climate activist Bill McKibben joined more than 30 organizations in calling for Pennsylvania Governor Tom Wolf to veto legislation that would dedicate more than $667 million to subsidies for the petrochemical industry. 

 

Wolf negotiated a backroom deal with state legislators to address his concerns with a similar bill he vetoed in March. Wolf used his veto of HB1100 as a bargaining chip to make changes to a provision on prevailing wages. The new version of the bill was added as an amendment to an unrelated bill, HB732, effectively bypassing the legislative process.

 

Actor and activist Mark Ruffalo said, “As fracking companies are going bankrupt, it is unconscionable that Governor Wolf is using state subsidies to prop them up. Governor Wolf is acting like a member of the Trump Administration, not the Democratic Governor of Pennsylvania. He has been meeting in secret with the fracking and plastics companies to give them millions in taxpayer dollars. Giving limited resources to fracking companies is obscene when so many people are trying to keep their homes, small business, schools, and families afloat, especially in light of the criminal charges that the state attorney general just slapped this industry with. Thousands Make Last Minute Appeal to Wolf, Legislators: Don’t Subsidize Polluters

Petition Challenges Attempt to Throw Billions at Petrochemical Industry while Constituents Struggle to Put Food on the Table

Today, the Better Path Coalition submitted more than 2,200 signatures on a petition started on Saturday when it received word that the state legislature was likely to move a bill that would be amended to contain the worst provisions of the controversial HB1100, the centerpiece of the GOP’s Energize PA package that would have given billions in subsidies to the petrochemical industry.  

​

The bill that will be amended to include the subsidies is HB732, introduced by Representative Chris Quinn (R-168) to exempt “volunteer service providers – EMS, fire, and rescue companies – from the Pennsylvania realty transfer tax,” according to the co-sponsorship memo.

​

Earlier in the week,  PLS Reporter revealed that lawmakers were negotiating with Governor Tom Wolf to resurrect the bill he vetoed but didn’t indicate how it might be done or how quickly it might happen. In the article, Department of Community and Economic Development Secretary Dennis Davin is reported to have signaled in February that Wolf’s veto threat wasn’t an expression of opposition to the substance of the bill.

​

“When elected officials go to the lengths of attaching a measure to another bill and then moving it quickly, it means they know exactly how unpopular a measure it is. In this case, the public’s opposition to HB1100 was loud and clear and that was before the economic crisis brought on by COVID-19 made the thought of throwing billions at the shale gas industry unconscionable. Governor Wolf should not have used his veto as a bargaining chip. We demand better of our legislators and governor,” said Karen Feridun, Co-founder of the Better Path Coalition, who started the MoveOn petition.

Lawmakers in northeastern PA were among those eager to override Wolf’s veto of HB1100. In June, Cabot Oil and Gas’ External Affairs Director George Stark facilitated a meeting with Senators Gene Yaw (R-23) and John Yudichak (I-14) and Gene Barr of the Pennsylvania Chamber of Business and Industry to discuss the bill and the campaign to save it. The shift from an override campaign to a negotiation with Wolf appears to have been concurrent with announcements from Attorney General Josh Shapiro regarding charges stemming from a Grand Jury investigation of fracking. The Grand Jury has charged Cabot Oil and Gas, a would-be beneficiary of HB1100, with nine felonies and six misdemeanors. Shapiro also announced charges against Range Resources, already a beneficiary of the petrochemical boom in southwestern PA,  and a scathing report on the failures of the state government to protect the public from fracking.

Coalition Calls for Resignations, Fracking Ban, Transparency in Wake of Grand Jury Report

Pair of letters to Governor Wolf and Attorney General Shapiro Lay Out Coalition’s Concerns/Demands

 

Today, the Better Path Coalition delivered letters to Governor Tom Wolf and Attorney General Josh Shapiro outlining concerns and demands stemming from the Grand Jury’s report on the state government’s failure to protect Pennsylvanians from shale gas development.

​

The letter to Wolf calls for the resignations of Department of Environmental Protection Secretary Patrick McDonnell and Department of Health Secretary Rachel Levine. Additionally, the coalition expanded on its call for a halt to further permitting of shale gas activities first made in a  letter sent to Wolf on June 17 that received no response. Given the extent of the failures of the state government cited in the Grand Jury’s report, the Coalition is calling for a ban on fracking. The Governor’s office has also ignored several requests from the Coalition for a meeting with Wolf. The letter asks, once again, for a meeting.

​

The letter to Shapiro requests a meeting to discuss the Coalition’s prioritized concerns. Among them are concerns about the reporting hotline Shapiro announced today.  The Grand Jury recommended giving the AG’s office original jurisdiction over environmental crimes. The Coalition is concerned that Shapiro could be hindered in acting on complaints unless a change in reporting methodology aids him in gaining that authority. The group is also calling for the lifting of existing nondisclosure agreements and a prohibition of their use in the future.

​

 “We are grateful to Attorney General Shapiro and the Grand Jury for the work they have done to expose the failures of the state to protect Pennsylvanians. The contents come as no surprise to those who have been profoundly impacted for 16 years. The damage to our communities, to our families, and to our natural resources cannot be undone. The only thing the state can do now is stop the madness. The results of the Grand Jury investigation thus far make a clear case for a ban on fracking in Pennsylvania and more is coming,” said Karen Feridun, Better Path Coalition.

“Fossil fuel companies have consistently operated in the belief that they are above the law and that they can willfully ignore any laws, rules, regulations, standards or even easement agreements with impunity,” said Ellen Gerhart, Camp White Pine. “They have bullied, intimidated and targeted anyone who refused to kowtow to their demands. DEP has also been complacent and has often aided and abetted these companies by erroneously issuing permits without checking the veracity of the information on the applications. When DEP has been forced to act against these companies for a multitude of violations, the result has been little more than a slap on the wrist. The DEP, the Wolf administration, and the fossil fuel industry should all be held accountable for their failure to ensure the health and safety of the people of Pennsylvania and the environment.”

“I was allowed to have phone meetings with Dr. Levine and the PA DOH epidemiology team in 2015, 2016 and 2017 to discuss the unusually high rates of cancer in areas of fracking. The meetings lasted for one hour or more each but always ended by thanking me for my time but informing me that Governor Wolf has tied their hands and they can only work on the opioid crisis. My response was that as important of an issue that is we have been Fracking in Pa for 16 years now and have ignored the suffering of an unknown amount of children and adults. Coalition to Wolf: Stop Permitting Crimes

In Wake of AG Announcements, Coalition Calls for Halt on New Fracking Permits

Today, the Better Path Coalition submitted a letter to Governor Wolf calling on him to direct Department of Environmental Protection Secretary Patrick McDonnell to halt further permitting of shale gas activities. The move comes in response to recent announcements of criminal charges against Range Resources and Cabot Oil & Gas resulting from a Grand Jury investigation. Attorney General Josh Shapiro has indicated that many more companies will be charged in the coming weeks.

 

We’ve been watching the Attorney General’s investigation warily to see if justice for impacted communities will at last be done. However, justice cannot be served if wrongdoers are only given a slap on the wrist and allowed to continue as before. Corporations insist they are “persons” under the law; let them suffer sanctions as people do. Criminals who inflict serious harm on others are removed from society. These drillers have been shown to be criminals and should be ‘removed’ from us by denying them any new drilling permits,” said Diane Sipe of Marcellus Outreach Butler and Co-founder of the Better Path Coalition.

The Coalition points to permits given out as the AG’s office was putting the finishing touches on its announcements on Range and Cabot. During the first half of June, the DEP issued 28 permits. Only five of those permits were issued to companies other than the two companies that were charged with crimes during that same period. Range received 6 permits; Cabot received 17.

​

“On Monday, Shapiro said the companies act like they’re above the law. That is not news to impacted Pennsylvanians and advocates who have watched fracking companies rack up thousands and thousands of permit violations. The state cannot reward recidivists with permits to do more damage. It’s time for the permitting to stop,” said Karen Feridun, Berks Gas Truth and Co-founder of the Better Path Coalition.

The letter closes, “Nothing resembling justice can be served if the protracted process of investigating these companies results in no more than fines and compulsory charitable contributions leaving one hand as new permits are placed in the other.”

Coalition Renews Call for Metcalfe’s Removal in Wake of Turzai’s Resignation

Statement from the Better Path Coalition

 

 

The Better Path Coalition hopes that Speaker Mike Turzai’s resignation sparks other changes in PA House leadership. Specifically, we are renewing our call for the removal of Representative Daryl Metcalfe from his chairmanship of the Environmental Resources and Energy committee.

 

Since last November, the coalition has gathered more than 6,500 signatures on a petition calling on Turzai to remove Metcalfe who openly rejects climate change and has used taxpayer-funded committee hearings to amplify the voices of fellow climate deniers. The first of the hearings occurred in March 2019, just months after he was assigned to chair the committee after being removed from the State Government committee for other expressions of extremist views he holds.

 

Speaker Turzai has never responded to our demands. We hope that his departure is the first step in transforming the state legislature from one that consistently puts corporate interests over public interest to one that is responsive to the people.

 

The coalition will now submit the petition to House Majority Leader Bryan Cutler as he assumes the role of temporary speaker.

Support for Metcalfe’s Removal as Enviro Chair Continues to Grow

Coalition Projects Message to Turzai on District Office in Advance of Petition Resubmission

 

Today, the Better Path Coalition resubmitted a letter from more than 40 organizations and businesses and a petition with nearly 6,500 signatures to Speaker Mike Turzai (R-28)  calling on him to remove Representative Daryl Metcalfe (R-12) as chairman of the Environmental Resources and Energy committee, citing his unabashed denial of climate change, obstructionism, and unprofessional behavior. The letter cited seven examples of Metcalfe’s unacceptable behavior and statements on climate change that span more than a decade.

​

The petition has received about 1,000 additional signatures in the month since it was first delivered on February 11. Turzai has never responded.

​

Last night, Better Path Coalition partners from Marcellus Outreach Butler projected a message on both Metcalfe’s district office calling for Turzai to act. The action is part of an escalating campaign to remove Metcalfe from his post as chair of the House committee that has more influence over how Pennsylvania addresses climate change than any other.

​

“Metcalfe’s extreme views and erratic behavior have already disqualified him from chairing the State Government committee. Speaker Turzai removed him from that post. He can and must remove Metcalfe from the Environmental Resources and Energy committee post for exactly the same reasons,” said Karen Feridun, Co-founder of the Better Path Coalition.

In January, Metcalfe devoted a Metcalfe Minute video to the petition after he learned that it had gathered 4,100 signatures. Said Metcalfe, “This unwarranted, personal attack from the deep pocketed climate alarmist lobby reinforces the fact that no other Pennsylvania Legislator has ever been targeted more than me for removal or resignation without having been involved in any crime or scandal. . . Why? Because I make no apologies for advancing only winning Republican policies through my Republican Majority Committee and I refuse to back down or be intimidated by any of these socialist mobs or their reprehensible, fake, fear generating tactics.”

“We in the Better Path Coalition have a different rejoinder: Representative Metcalfe is targeted because he is unsuitable for the position he holds. He named it himself; he prioritizes advancing partisan bias over sound environmental policies. He has repeatedly proven true to his words, demonstrated by the hearings he has held on climate change that primarily featured climate deniers and skeptics,” said Diane Sipe of Marcellus Outreach Butler, Better Path Coalition partner.

During the only debate of Turzai’s 2018 re-election campaign, when asked about climate change, he responded, “I do think that there is climate change and we have to find a way to reduce our emissions.” He has never publicly squared that position with his choice of Metcalfe as chair of the committee responsible for moving bills to help the state achieve those reductions.

​

The Better Path Coalition maintains that Metcalfe is unfit to Chair the committee because he is not only out of step with the settled science, he is out of step with the majority of Pennsylvanians. Yale University’s Climate Change Communication Program, revealed that 65 percent of Pennsylvanians (67 percent of Americans) think climate change is happening and a majority believe it is mostly caused by human activity. According to the county-by-county breakdown, 57% of the residents of Butler County, in which Metcalfe’s district lies, think climate change is already happening, as do 71% of residents in Allegheny County where Turzai’s district is located.

Thousands Say Metcalfe is the Wrong Person to Chair House Environmental Committee

More than 35 organizations and 5,500 citizens call on Speaker Turzai to Remove Metcalfe

 

A year after Representative Daryl Metcalfe (R-12) was named chair of the House Environmental Resources and Energy Committee, thousands of Pennsylvanians are calling for his removal because of his unabashed climate denial, obstructionism, and unprofessional behavior.

​

Today, the Better Path Coalition submitted a petition with more than 5,500 signatures to Speaker Mike Turzai (R-28), along with a letter signed by 38 organizations. The letter cites seven examples of Metcalfe’s unacceptable behavior and statements on climate change that span more than a decade. 

​

The earliest example, from 2009, says, “As a veteran, I believe that any veteran lending their name, to promote the leftist propaganda of global warming and climate change, in an effort to control more of the wealth created in our economy, through cap and tax type policies, all in the name of national security, is a traitor to the oath he or she took to defend the Constitution of our great nation!" Mr. Metcalfe's email reads. "Remember Benedict Arnold before giving credibility to a veteran who uses their service as a means to promote a leftist agenda. Drill Baby Drill!!!" Coalition Applauds Congressional Climate Champions'

Bill to Ban Fracking Nationwide

The Better Path Coalition applauds Senators Bernie Sanders and Jeff Merkley and Representatives Alexandria Ocasio-Cortez and Darren Soto for introducing legislation to establish a federal ban on fracking. The legislation will be welcome news for the 48% of Pennsylvanians who support a ban according to a just-released Franklin & Marshall poll, especially since the news comes on the heels of Governor Tom Wolf's re-unveiling of his Restore Pennsylvania plan. All but three of the state’s 21 Democratic senators have co-sponsored the plan that would condemn the state to 20 more years of drilling and fracking and incentivize the oil & gas industry.

 

It is increasingly clear that any divide within the Democratic Party in Pennsylvania over fracking exists solely between the people and those who are presumably in office to represent them. The legislation announced today is a much-needed intervention by Congressional climate leaders. Perhaps it will have the added benefit of providing the state’s Democratic leaders with some insight into what being a champion of the people looks like.

Seriously? Restore PA again?

Few people rival Governor Tom Wolf in his ability to ignore reality and keep on pressing for something that would be devastating to his state, its citizens, and future generations. On the anniversary of the unveiling of his outlandish Restore Pennsylvania plan, he trotted out agency chiefs to help him re-unveil it. DEP Secretary Patrick McDonnell, DCNR Secretary Cindy Dunn, and PEMA Director Randy Padfield should be concerned that Restore Pennsylvania would condemn the state to 20 more years of fracking, incentivize the petrochemical industry, and exacerbate climate change. Why they are not is a question only they can, and should be required to, answer.

 

The Better Path Coalition pressured legislators to remove their names as co-sponsors. We will continue to press legislators to join their colleagues who pulled their support. The stakes are much higher this year.

 

In the past year, we have witnessed climate impacts that are coming faster and more furiously than the scientific community predicted. We’ve learned that at least 67 young people in four counties in southwestern Pennsylvania have been diagnosed with rare cancers that may be linked to shale gas activities. We have 10 years left to address the climate. Some of the young cancer victims didn’t get 10 years. Every day that Governor Wolf crisscrosses the state to drum up support for Restore Pennsylvania is precious time lost.

Advocates Call for Transparency and Public Engagement as DOH Explores Fracking’s Health Impacts

Groups Call for Town Hall and Meeting with Public Health Organizations

 

Today, a group of public health and environmental advocates submitted a letter to Secretary Rachel Levine, calling on her to participate in a town hall on the studies on the health impacts of fracking Governor Tom Wolf announced in November. Additionally, Physicians for Social Responsibility Pennsylvania and the Southwest Pennsylvania Environmental Health Project have requested a meeting with Secretary Levine.

 

The organizations that submitted the letter are the same groups that coordinated the letter to Governor Wolf last June that called for an investigation into the spike in rare cancers diagnosed in young people in four counties in southwestern Pennsylvania. 

 

“Parents and families, and their doctors, are anxiously waiting for answers about whether something in the environment is associated with an alarming number of rare childhood cancers, including Ewing sarcoma, in heavily fracked counties of southwestern Pennsylvania,” said Dr. Ned Ketyer, pediatrician with Physicians for Social Responsibility Pennsylvania and Southwest Pennsylvania Environmental Health Project. “We wish to work with PA-DOH Secretary, Dr. Rachel Levine, and her staff to ensure their planned investigation is thorough and transparent, and completed in a timely manner.”

 

“The forum at Canon-McMillan last October left the public with more questions than answers. They are questions that can’t wait and, in some cases, may never be answered by studies. Concerned community members and advocates deserve a chance to have their questions addressed by Secretary Levine directly. We urge her to agree to participate in a forum we will organize and facilitate,” said Karen Feridun, Co-founder of the Better Path Coalition.

 

“We appreciate that the administration is taking this first, vital step toward protecting public health by committing to conduct two investigations into the relationship between shale gas development and the health effects residents are experiencing,” said Sarah Rankin, public health nurse for the Southwest Pennsylvania Environmental Health Project. “As a public health organization with a long history of community engagement in the region, we invite Dr. Levine to meet with us and Physicians for Social Responsibility - Pennsylvania to discuss her plan for keeping local communities informed and protected from exposure while the investigations are ongoing. Our communities, our families, and our children deserve no less.”

 

“There is no question that fracking is a threat to our drinking water, our air, and to the health and safety of people whose communities have been turned into sacrifice zones,” said Megan McDonough, Pennsylvania Organizing Manager for Food & Water Action. “In November, the governor told suffering families that his administration wanted to do more research on the rising number of cancers in heavily fracked communities—but he has taken no action since then. Two months later, parents, families, and their doctors, are still waiting to hear details of the planned studies. With the health and safety of our children on the line, we cannot wait another 3 years for answers.”

 

Walter Tsou, MD, MPH, Executive Director of Physicians for Social Responsibility Pennsylvania explains,"There should be an independent study process overview to ensure independent, objective advice throughout the entire process from selection of researchers to response to peer reviewed publication. The study should welcome healthcare providers and public health experts, whose input should complement the concerns of the community most directly impacted. Community input is integral to understanding pathways to exposure and members of the community who have signed non-disclosure agreements must be released from any penalties for sharing relevant health information with the independent academic researchers.  All aspects of the UGD industry that may be part of the possible pathway to exposure must be included in the study. We acknowledge that a large body of literature that already exists on the health harms of shale gas development. The “Compendium of Scientific, Medical, and Media Findings Demonstrating Risks and Harms of Fracking (Unconventional Gas and Oil Extraction)” is a compilation of investigative reports, government assessments, and roughly 1,500 peer-reviewed research articles, which concluded fracking cannot be done without risking harm to human health. There should be a moratorium to ensure that no further harm is done.  We urge the governor to hold the shale gas industry accountable for health impacts, and to have all state and local municipalities abide by the precautionary principle as a measure of protection to Pennsylvania residents until the results of the studies are revealed."

DEP Fine on ETC Is Cold Comfort

Pennsylvanians jaded by the Department of Environmental Protection’s poor track record for holding polluters to account will be unmoved by the agency’s historic fine on ETC, the company that has laid waste to communities across the Commonwealth. Instead, they will shudder at the thought that the company will be able once again to get permits for its projects. Secretary Patrick McDonnell stated that the company has demonstrated its intention to correct its unlawful conduct to DEP’s satisfaction. Unfortunately, that is not a high bar in a state where families whose wells have been contaminated as a result of drilling activities are left to their own devices to find replacement water, where a previously ‘historic’ fine against Range Resources was reversed by the agency without explanation, and where the unfolding climate crisis, the ultimate crime against nature, has not dampened our regulators’ zeal to enable continued greenhouse gas development. DEP’s action is an inauspicious start to the last decade we have left to avoid climate disaster.

Legislation Won’t Make Fracking Safe

A week after Article 1, Section 27 turned 50, Attorney  General Josh Shapiro and Democratic legislators invoked the amendment as they laid out legislative proposals to address the recommendations made by the 43rd Statewide Grand Jury in its report last June that concluded that the government has not protected Pennsylvanians from fracking. The Better Path Coalition appreciates efforts to address the important issues the Grand Jury raised, but cautions that it is not correct to suggest, as Attorney General Shapiro did, that fracking can be done safely.

 

As the Compendium of Scientific, Medical, and Media Findings Demonstrating Risks and Harms of Fracking (Unconventional Gas and Oil Extraction) has concluded, “Our examination uncovered no evidence that fracking can be practiced in a manner that does not threaten human health directly and without imperiling climate stability upon which public health depends.”

 

Since first announcing the Grand Jury report, Attorney General Shapiro has referred to nosebleeds suffered by some Pennsylvania children living in proximity of fracking. Prevalence of nosebleeds was mentioned during today’s press conference once again. Peer-reviewed research has linked fracking to many devastating illnesses, diseases, and conditions. Young people in four counties in southwestern Pennsylvania have been diagnosed with rare cancers. The health impacts go far beyond nosebleeds. No amount of legislation is sufficient to safeguard the public and uphold the protections guaranteed in Article 1, Section 27.

 

It is dangerous to suggest that a package of bills will make fracking safe when there is nothing in the science that supports that conclusion and when even the best attempts to address on-the-ground impacts will not address the climate impacts of fracking.
